Terms & Conditions

These Terms and Conditions (“Terms”) govern all services provided by Winify (“Company”, “Winify”, “we”, “us”, or “our”). By requesting, booking, or using any services provided by the Company, the customer (“Customer”, “Shipper”, “Consignor”, or “Client”) agrees to be bound by these Terms.

1. Definitions

For the purpose of these Terms

Company - Means Winify , its employees, agents, contractors, and authorized representatives.

Customer / Shipper / Consignor - Means any person, company, or entity requesting services from the Company.

Goods / Shipment - Means any cargo, parcel, documents, or items entrusted to the Company for transport, handling, storage, or related services.

Carrier - Means any third-party transportation provider including airlines, shipping lines, courier partners, trucking companies, or rail operators used by the Company to move shipments.

2. Scope of Services

The Company provides logistics and freight services including but not limited to:

  • Domestic and International Courier
  • Air Freight
  • Ocean Freight
  • Road Transport
  • Customs Clearance
  • Warehousing
  • Cargo Handling
  • Documentation and logistics coordination


Unless explicitly stated otherwise in writing, the Company acts solely as a facilitator, freight forwarder or logistics intermediary and not as a carrier.

The Company reserves the right to subcontract services to third-party carriers, agents, or service providers without prior notice.

The Company shall not be responsible for the acts, errors, delays, or omissions of such third-party service providers.

3. Customer Responsibilities

The Customer agrees to:

  1. Provide accurate and complete shipment information, including nature, weight, dimensions, and value of goods.
  2. Ensure that the shipment complies with all applicable laws, regulations, and customs requirements.
  3. Properly package and label the goods for safe transport.
  4. Provide all necessary documentation required for customs clearance and transportation.

The Customer shall be solely responsible for any losses, penalties, fines, delays, or damages arising from inaccurate information, misdeclaration, or incomplete documentation.

4. Packaging and Labeling

The Customer is responsible for ensuring that all goods are:

  • Properly packed
  • Adequately protected
  • Clearly labelled
  • Suitable for transportation

The Company shall not be liable for any loss or damage resulting from:

  • Inadequate packaging
  • Improper labelling
  • Sending Fragile items not declared as fragile
  • Inherent defects in the goods
  • Improper handling instructions not disclosed.

5. Prohibited and Restricted Goods

The Company reserves the right to refuse transportation of any shipment containing prohibited or restricted items including but not limited to:

  • Hazardous materials
  • Explosives or weapons
  • Illegal substances
  • Counterfeit goods
  • Perishable goods without prior approval
  • Live animals
  • Currency or negotiable instruments

If such goods are shipped without proper declaration, the Customer shall indemnify and hold the Company harmless against all resulting liabilities.

6. Cargo Insurance

Shipments are not insured by default.

We do not arrange Cargo insurance. Customer would need to arrange their own cargo insurance.

In the absence of such insurance, shipments shall travel entirely at the Customer’s risk, subject to the liability limitations set out in these Terms.

7. Limitation of Liability

The Company’s liability for any loss or damage to goods shall be strictly limited.

The Company is liable only to the consignor/shipper for any loss or damage to the shipment to the extent of loss or damage to a document or parcel actually sustained ,subject to maximum amount of Rs 100 in case of domestic packages and Rs 2000 in case of international packages. 

The Company shall not be liable for loss or damage caused by:

  • Acts of God
  • Natural disasters
  • War or civil disturbances
  • Government actions
  • Customs delays or inspections
  • Strikes or labor disputes
  • Carrier operational failures
  • Inherent defects of goods.


8. Exclusion of Consequential Loss

Under no circumstances shall the Company be liable for:

  • Loss of profit
  • Loss of business
  • Loss of market
  • Loss of opportunity
  • Indirect or consequential damages

even if the Company has been advised of the possibility of such damages.

9. Delivery Times

Transit times are provided as estimates only.

The Company does not guarantee delivery dates and shall not be liable for delays caused by:

  • Weather conditions
  • Airline or shipping line schedules
  • Customs inspections
  • Port congestion
  • Transport disruptions
  • Government regulations.

10. Claims Procedure

Any claim for loss or damage must be submitted in writing within seven (7) days from the date of delivery or the expected delivery date.

The claim must include:

  • Commercial invoice
  • Packing list
  • Proof of shipment value
  • Photographs of damaged goods (if applicable)
  • Supporting documentation

Failure to submit a claim within the required period shall result in automatic rejection of the claim.

The Company reserves the right to inspect the goods before processing any claim.

11. Freight Charges and Payments

All freight charges, duties, taxes, and related costs must be paid in accordance with the agreed payment terms.

Unless otherwise agreed:

  • Payment is due prior to shipment dispatch.
  • Late payments may incur interest at 18% per annum.
  • The Customer remains liable for all government duties, customs charges, and regulatory fees.

12. Right of Lien

The Company shall have a general lien on all goods and documents in its possession for any unpaid charges owed by the Customer.

If payment remains outstanding for more than 30 days, the Company reserves the right to:

  • retain the goods,
  • sell the goods, or
  • dispose of the goods

in order to recover outstanding amounts.

13. Indemnity

The Customer agrees to indemnify and hold harmless the Company, its employees, agents, and contractors against any claims, losses, damages, fines, or expenses arising from:

  • inaccurate shipment information
  • prohibited goods
  • regulatory violations
  • improper packaging.

14. Force Majeure

The Company shall not be liable for any failure or delay in performing its obligations due to events beyond its reasonable control including but not limited to:

  • natural disasters
  • pandemics
  • strikes
  • war
  • government restrictions
  • port closures
  • transportation disruptions.

15. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India.

Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts located in Delhi, India.

16. Amendments

The Company reserves the right to modify or update these Terms at any time without prior notice.

The latest version shall always be available on the Company website.

Continued use of the Company’s services constitutes acceptance of the updated Terms.

17. Entire Agreement

These Terms constitute the entire agreement between the Company and the Customer and supersede any prior agreements, representations, or understandings.
